Important: meeting hosts are responsible for telling participants that recording is taking place and obtaining every consent required by applicable law.
Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of Lomer's websites, applications, meeting rooms, recording tools, and related services (the “Service”). By creating an account, hosting or joining a meeting, or otherwise using the Service, you agree to these Terms.
If you use Lomer for an organization, you confirm that you have authority to bind that organization. In that case, “you” includes the organization. If you do not agree to these Terms, do not use the Service.
Eligibility
You must be legally able to enter into a binding agreement and be at least 18 years old, or the age of legal majority where you live, to create an account. Participants under 16 may use the Service only when a parent, guardian, school, or other authorized adult has provided any consent required by law and the meeting host permits their participation.
The Lomer service
Lomer provides browser-based video meetings and locally captured recordings. Depending on the features available to you, hosts can schedule meetings, invite guests with a link, record separate participant tracks, process a combined recording, recover interrupted uploads, and stream or download completed recordings.
Recording quality and availability depend on participants' devices, browsers, permissions, local storage, network connections, and successful uploads. You are responsible for keeping an independent backup of content you cannot afford to lose.
Accounts and security
You must provide accurate account information, keep it current, and protect your credentials and meeting links. You are responsible for activity under your account, except to the extent caused by Lomer's breach of these Terms.
Tell us promptly if you suspect unauthorized access. We may require identity or email verification and may restrict access when reasonably necessary to protect the Service, recordings, or other users.
Recording notice and consent
Hosts are responsible for recording law compliance. Laws about recording conversations vary by location and may require consent from every participant. Before recording, the host must give clear notice, obtain all required permissions, and explain how the recording will be used and shared.
If you join as a participant and do not consent to a recording, tell the host and leave the meeting before recording begins. Lomer's recording indicators and controls do not replace the host's legal obligations.
Hosts must not record minors, confidential material, health information, financial information, or other sensitive content unless they have a lawful basis and appropriate safeguards.
Your content
You retain the rights you hold in video, audio, names, meeting details, and other material submitted to the Service (“Content”). You grant Lomer a limited, non-exclusive license to host, copy, transmit, process, format, and display Content only as needed to operate, secure, and improve the Service, comply with law, and follow your instructions.
You confirm that you have the rights and permissions needed to upload and use Content and to grant this license. You are responsible for how you share downloaded recordings and for claims arising from your Content or your use of another person's content.
Acceptable use
You must not use the Service to:
- break the law, record people unlawfully, or violate privacy, publicity, intellectual property, or other rights;
- harass, exploit, threaten, defraud, impersonate, or harm another person;
- create, upload, or distribute illegal, abusive, sexually exploitative, or malicious content;
- introduce malware, disrupt the Service, bypass access controls, probe for vulnerabilities, or gain unauthorized access;
- use automated means to scrape or overload the Service, except as expressly permitted in writing; or
- resell, reverse engineer, or copy the Service except where law expressly permits it.
We may investigate suspected violations and remove or restrict access to Content when reasonably necessary to protect users, comply with law, or enforce these Terms.
Third-party services
The Service depends on third-party infrastructure and may let you use services such as Google sign-in or external calendar links. Your use of a third-party service is governed by that provider's terms and privacy policy. Lomer is not responsible for a third-party service outside our control.
Fees and future plans
Some features may be offered without charge or as a preview. If Lomer introduces paid plans, prices, billing terms, usage limits, taxes, and cancellation rules will be disclosed before you are charged. We may change or discontinue free features with reasonable notice where practical.
Changes and availability
We may add, change, suspend, or discontinue parts of the Service. Planned and unplanned maintenance, provider outages, security events, or circumstances outside our control may interrupt access.
Beta, preview, and recovery features may be incomplete, change without notice, or fail to preserve Content. We do not promise that every browser, device, codec, or connection will be supported.
Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially or repeatedly violate these Terms, create a security or legal risk, fail to pay an applicable fee, or if continued operation is no longer commercially practical.
Where reasonable, we will provide notice and an opportunity to export available Content before termination. We may act immediately when needed to prevent harm, comply with law, or protect the Service. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and dispute terms.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Lomer disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that a meeting or recording will connect, upload, process, recover, or remain available. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Lomer and its suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, recordings, or business opportunities, arising from or related to the Service.
To the fullest extent permitted by law, Lomer's total liability for all claims relating to the Service will not exceed the greater of the amount you paid Lomer for the Service during the 12 months before the event giving rise to the claim or US$100. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnity
If you use the Service for a business or organization, you will defend and indemnify Lomer and its personnel against third-party claims, losses, and reasonable costs arising from your Content, your unlawful recording or sharing, your violation of these Terms, or your violation of another person's rights, except to the extent caused by Lomer's own breach or misconduct.
Governing law and disputes
If an order form, paid plan, or separate written agreement identifies governing law and courts, those terms apply. Otherwise, these Terms are governed by the laws of the place where the operator of Lomer is established, without regard to conflict-of-laws rules, and disputes must be brought in the courts located there.
Before filing a claim, each party will try in good faith for 30 days to resolve the dispute informally. This section does not prevent either party from seeking urgent injunctive relief, and it does not limit mandatory consumer rights or legal protections that apply where you live.
General terms
These Terms and any applicable order or plan terms are the entire agreement about the Service. If a provision is unenforceable, it will be adjusted only as much as necessary and the remaining provisions will continue in effect. A delay in enforcement is not a waiver.
You may not assign these Terms without our consent. We may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets. Headings are for convenience only.
Changes and contact
We may update these Terms as the Service or law changes. We will post the revised Terms, update the effective date, and give additional notice when required. Continuing to use the Service after the updated Terms take effect means you accept them.
Questions about these Terms may be sent through the support contact published in the Lomer Service.
